Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CamPanther platform, desktop application, browser extension, APIs, and related services (collectively, the “Service”). CamPanther® is a registered trademark and the product and trading name of the operating entity identified below (“CamPanther”, “Company”, “we”, “us”, or “our”). The operating entity is a company registered in England and Wales (company number 16286389), registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. By accessing or using the Service, you (“Customer”, “you”, or “your”) agree to be bound by these Terms, the Acceptable Use Policy, the Privacy Policy, and any order-specific terms, each incorporated by reference. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

1. Definitions

• “Service” means the CamPanther web application, desktop application, browser extension, APIs, and related software, tools, and functionality.
• “Customer” means the cam studio, organization, or solo creator that has registered for the Service.
• “Authorized User” means an individual the Customer permits to use the Service under the Customer’s account (e.g., owners, managers, operators, accountants).
• “Performer” and “Fan” mean third-party individuals whose personal data the Customer brings into or processes through the Service.
• “Customer Data” means data you or your Authorized Users upload, input, generate, or instruct us to process through the Service.
• “Third-Party Platform” means any cam site, streaming destination, social platform, payment provider, or other third-party service the Customer connects to or uses alongside the Service.
• “Subscription” means your paid access to the Service under an active plan.

2. Eligibility & Account

The Service is offered to businesses and professional adult content creators. You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Service. You agree to provide accurate registration information, to keep your credentials secure, and to be responsible for all activity under your account. We may request proof of age or identity at any stage and may suspend access pending verification.

3. Nature of the Service; Disclaimers of Status

CamPanther is a software tool. The following characterizations are fundamental to these Terms:

• CamPanther is not a content host, cam site, or platform for publishing sexually explicit media. We do not host, store, ingest, transcode, relay, manage, curate, or distribute sexually explicit content. Multistreaming is performed locally on your own equipment; we do not operate a cloud relay for stream content.
• CamPanther is not a “producer” within the meaning of 18 U.S.C. §§ 2257 / 2257A or 28 C.F.R. Part 75. We do not create, arrange, manage, or control the production of any sexually explicit content and we are not a records custodian under those provisions. You (or the applicable producer) are solely responsible for all age-verification and record-keeping obligations.
• CamPanther is not a money transmitter, money-services business, payment processor, escrow agent, bank, or fiduciary. We never take custody of, hold, or transmit creator, performer, or fan earnings. Payout features calculate figures and generate files/reports only; funds move exclusively through your own banks and payment providers.
• CamPanther is not affiliated with, sponsored by, or endorsed by any cam site, streaming platform, or host (including but not limited to Chaturbate, Stripchat, MyFreeCams, LiveJasmin, BongaCams, CamSoda, Cam4, Flirt4Free, Streamate, OnlyFans, or Fansly). All third-party names and marks belong to their respective owners.

4. License & Restrictions

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal business use during your Subscription. You will not, and will not permit any person to: (a) reverse engineer, decompile, disassemble, or attempt to derive source code; (b) copy, frame, mirror, resell, or build a competing product; (c) circumvent or interfere with the Service’s security, rate limits, or access controls; (d) scrape, crawl, or use automated means against the Service except via documented APIs; or (e) use the Service in violation of the Acceptable Use Policy or applicable law. The desktop application and browser extension are licensed, not sold, and are subject to these Terms, including auto-update.

5. Customer Data & Intellectual Property

You retain all right, title, and interest in and to Customer Data. You grant us only a limited, worldwide, royalty-free license to host, store, process, transmit, and display Customer Data solely to provide, secure, and support the Service for you and as instructed by you. We claim no ownership of Customer Data.

We do not use Customer Data, Performer data, or Fan data to train artificial-intelligence models except where you give us prior, specific, opt-in consent. We may create and use aggregated and de-identified data that does not identify you, any Performer, or any Fan and cannot reasonably be re-identified, for operating, securing, and improving the Service.

If you submit suggestions or feedback, you grant us a non-exclusive, royalty-free license to use it to improve the Service. We do not require an assignment of your ideas. All right, title, and interest in the Service, the CamPanther software, and the CamPanther® marks remain ours or our licensors’.

6. Third-Party Platforms & Their Terms

The Service helps you operate accounts and workflows on Third-Party Platforms that you control. You are solely responsible for ensuring that your use of the Service complies with the terms of service, acceptable-use rules, API rules, exclusivity arrangements, and anti-automation or anti-restreaming rules of every Third-Party Platform you use, including whether simultaneous or multi-site streaming is permitted. You represent and warrant that you have all rights and authority to access and operate every account you connect to the Service. We make no representation that use of the Service complies with any Third-Party Platform’s terms, and we are not liable for account suspensions, bans, penalties, lost revenue, or contract breaches arising from your use of Third-Party Platforms.

7. Browser Automation & Privacy Features

The Service does not bypass, disable, or circumvent any Third-Party Platform’s authentication, login, or access-control mechanisms. Any session-management or privacy/anti-fingerprinting functionality operates only within sessions you authenticate using your own credentials. All actions performed through such functionality are performed under your own credentials and are legally attributable to you, not to CamPanther. You are responsible for determining whether such use is permitted by any Third-Party Platform.

8. AI Features

Certain features (including the AI Performance Coach and AI-assisted translation or suggestions) use automated processing. AI outputs are advisory and informational only, are provided “as is” without warranty of accuracy, completeness, or fitness, and do not constitute professional, financial, legal, tax, or business advice. AI features are designed to keep a human in the loop and are not intended to make decisions producing legal or similarly significant effects solely by automated means. You are solely responsible for reviewing and verifying AI outputs before relying on or acting on them, and for disclosing to your end users, where required by law, when they are interacting with automated systems. We are not liable for decisions or actions taken in reliance on AI outputs.

9. Payouts & No Money Transmission

Payout features are informational tools that calculate amounts and generate files or reports based on data you provide or instruct us to process. They are not a payment, settlement, escrow, or money-transmission service. We do not hold or move funds. You are solely responsible for verifying all payout calculations and for the actual movement of funds through your own banking and payment relationships. We provide no warranty as to the accuracy of any payout figure and are not liable for payout errors. Nothing in the Service is tax, accounting, or financial advice.

10. DMCA & Copyright

Our DMCA / Copyright Policy is incorporated by reference and governs copyright complaints and the optional takedown-assistance feature. Where we submit takedown notices at your instruction, we act solely as your authorized agent and you remain the principal and responsible party.

11. Acceptable Use

Your use of the Service is subject to the Acceptable Use Policy, which is incorporated by reference. Violation of the Acceptable Use Policy is a material breach of these Terms and may result in immediate suspension or termination and, where required by law, reporting to authorities.

12. Fees, Billing & Auto-Renewal

Fees, billing cycles, free trials, auto-renewal, cancellation, and refunds are governed by the Payment & Refund Policy, incorporated by reference. Subscriptions may renew automatically; auto-renewal terms, renewal reminders, and a clear cancellation method are described in that policy. Where you are a consumer, your statutory rights (including any applicable EU/UK withdrawal rights) are unaffected.

13. Term, Suspension & Termination

These Terms apply while you use the Service. We may suspend or terminate access immediately, with or without notice, for: suspected breach of these Terms or the Acceptable Use Policy; suspected illegal activity; risk to the Service, other customers, or third parties; non-payment; or sanctions/legal requirements. On termination, your right to use the Service ends; you may export Customer Data during a limited window after which we may delete it, subject to legally required retention. Sections that by their nature should survive (including 3, 5, 9, 14–19) survive termination.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DATA (INCLUDING STREAM-TIME, ANALYTICS, ALERTS, AND PAYOUT FIGURES) WILL BE ACCURATE OR TIMELY, OR THAT USE OF THE SERVICE WILL COMPLY WITH ANY THIRD-PARTY PLATFORM’S TERMS. Some jurisdictions do not allow certain warranty exclusions; those exclusions apply to the maximum extent permitted.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE FEES YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (ii) USD $100. THESE LIMITS DO NOT APPLY TO: your indemnification obligations; your breach of the Acceptable Use Policy; amounts owed for the Subscription; or liability that cannot be limited by law (including fraud, willful misconduct, or death or personal injury caused by negligence).

16. Indemnification

You will defend, indemnify, and hold harmless CamPanther and its officers, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising from or related to: (a) your use of the Service or any Customer Data; (b) your or your Authorized Users’ violation of any Third-Party Platform’s terms, or any tortious-interference claim arising from such use; (c) any content, communications, or materials created, sent, or processed by you or on your behalf, including where AI-assisted; (d) any failure by you or the applicable producer to meet age-verification or 18 U.S.C. §§ 2257 / 2257A obligations; (e) any takedown notice submitted at your instruction, including claims under 17 U.S.C. § 512(f); (f) sanctions or export violations; and (g) processing of any personal data without a lawful basis or required consents.

17. Sanctions & Export

You may not access or use the Service in, or for the benefit of any person or entity in, any jurisdiction subject to comprehensive sanctions (including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions), or if you are on any restricted-party list. You represent that you are not so located or listed and will not export or re-export the Service contrary to applicable sanctions and export laws. We may screen, geo-block, suspend, and report as required.

18. Confidentiality

Each party will protect the other’s non-public information disclosed in connection with the Service with reasonable care and use it only to perform under these Terms, except where disclosure is legally required.

19. Governing Law, Forum & Dispute Resolution

[Pending counsel] These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property or prevent abuse. Where you are a consumer, you retain the benefit of any mandatory consumer-protection rights and forum rights available to you under the law of your country of residence; nothing here deprives you of those rights. For customers in the United States, to the extent permitted by law, the parties waive any right to a jury trial and agree that claims will be brought only in an individual capacity and not as part of any class or representative proceeding.

20. Changes to These Terms

We may update these Terms. For material changes, we will provide at least 14 days’ notice before they take effect (by email or in-product notice). If you do not agree to a change, you must stop using the Service and may close your account before the change takes effect. Continued use after the effective date constitutes acceptance.

22. Miscellaneous

These Terms (with the incorporated policies) are the entire agreement between you and us regarding the Service. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. Neither party is liable for delays caused by events beyond reasonable control. Beta or early-access features are provided “as is” and may change or be withdrawn.
