1. Reporting alleged infringement

If you believe content made available through the Service infringes your copyright, send a written notice to our Designated Agent including: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and information reasonably sufficient to locate it; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law; and (f) a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the rights holder.

3. Counter-notice

If you believe material was removed or disabled by mistake or misidentification, you may submit a counter-notice with: your signature; identification of the material and its prior location; a statement under penalty of perjury of good-faith belief that the material was removed by mistake or misidentification; and your contact information and consent to jurisdiction as required by 17 U.S.C. § 512(g).

4. Repeat infringers

We will, in appropriate circumstances, suspend or terminate the accounts of customers who are repeat infringers.

5. Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages. Submit notices and counter-notices in good faith and only after considering whether the use is lawful (including fair use).

6. Takedown-assistance feature (optional)

Where you use CamPanther’s optional content-monitoring or takedown-assistance feature, the following terms apply in addition to the Terms of Service:

• You represent and warrant that you own or control the rights in the content you ask us to monitor or protect, and that you have authority to authorize takedown notices.
• You instruct and authorize CamPanther to act solely as your agent in submitting notices on your behalf. You remain the principal and the responsible party; “anonymous” submission means we submit as your agent without naming you publicly, not that you cease to be the principal.
• You warrant that each notice is accurate, submitted in good faith, and made only after good-faith consideration of lawful use including fair use.
• We do not guarantee removal of any content and do not adjudicate disputes. Counter-notices and disputes are routed back to you to handle.
• You indemnify CamPanther against any claim, including under 17 U.S.C. § 512(f) or for misrepresentation, wrongful takedown, or tortious interference, arising from notices submitted at your instruction. We may retain records of your authorization.
